I know this accident is aviation related but out of respect to those involved I don't think the photos should even be posted on this forum. Except that it seems the relatives, or at least a fair few of them, were the driving force behind the release of these images. A quagmire tho, with all sorts of ramifications.

Still doesn't justify what appears to be a judicial circumvention of the copyright holders rights and wishes.

Was reading Ayrton Senna's biography and there was a photographer that jumped the fence after his crash in Imola and took pictures of him in the cockpit of this car. The photographer in question has shown these photos to the family and his girlfriend at time but they have stayed in a vault somewhere despite large offers for their publication.
Surely this is something that could have happened to these images?

I've been away and only just read the latest posts here - I am very annoyed and quite sickened at how low our media has stooped in the completely unnecessary publication of these dreadful photos. I have known for some time that the newspaper ghouls have been battling to have the photos released, against the express wishes of the photographer. I really cannot believe this has actually gone ahead and they have breached his wishes and rights, these media people are sick, greedy arseholes as far as I am concerned and as a result I have removed the photo. The coroner should be investigated too.

Hi everyone. My name is Nicky Bennett, Val was my mother in law and her cousin Denise, killed in the balloon crash... as you can see this event is still with us, we have peace bit from time to time you, for lack of a better word float back there.... I happened upon this post and shared it with Gavin and we felt the need to reply.... we wanted to thank you all for your comments, your kindness and caring thoughts are very obvious in your posts. It means a lot. We wanted to address a couple of comments in support. We did NOT agree to the release of the photos, but our wants fell on deaf ears. It has not changed anything, but it has caused us pain when they all of a sudden show up on tv or social media. And yes this happens, even when we live in Chicago. Just a few months ago they showed up on my Facebook feed, an advert for "pictures of world tragedies". Geoff Walker the photographer actually did offer all the families a disc with the pictures very soon after the crash knowing that some folks may need that closure. He from the first moment cognizant of protecting all of us from the public desire to release the images for folks to stare at. I wish we could say the same for the coroner who never even took the time to ask us all how we felt. We felt from day one, that if one direct relative or loved one said no to releasing them, then that was enough, it should have been unanimous. There was at least 3 families that we know of that said no. Regardless of whether you can see people or not certainly doesnt remove them from the painful images, which you all seem to clearly and lovingly understand. Geoff is now living in Uganda doing amazing wonderful humanatarin work via the Lions Club. We are so proud of him and are honoured to call him a friend. He felt he had to leave NZ due to how the coroner and the system treated him, it hurt too much and he also lost loved ones as he knew many on board. Anyway, the point of this message, if any of you get to see it, is to thank you all for all your kind comments and caring thoughts. Please know it makes a difference, even this many years down the road and we really really really appreciate you all! Kia ora Gavin and Nicky Bennett.

I wonder if TVNZ or the papers using the photos paid a commercial rate for their use. Even if the Coroner released them, surely the media still need to obtain permission from the owner of the photos. As commented above, TVNZ and media can't claim copyright of any of their material if this is the way the treat other photographers. No, the media did not pay nor get permission. The court deemed them public. Anyone can now use those 4 photos...

Surely this is something that could have happened to these images? One of the Wairarpa Times Age journalist actually did the same that day, before the tarp was placed over the bodies. He destroyed the images after realizing the ramifications. He was a old class mate of Gavins and told us it was a huge moment for him once he realised he just took images of the remains of someone he knew, Gavins mum. It made him realize what pain they would create for others. He sat down with us before we returned to the usa to apologize for taking them. A good man....

Yes indeed, Nicky and Gavin. With Dave and John on your sentiments.
I hear you regarding the photographs; frustrating that they were made public to begin with, as once images get on social media they become the property of the site on which they sit, like faecesbook, because it can do with them whatever it wants. All copyright is removed. There is no legistlation surrounding pictures because the companies running these things have written the rules themselves.
