Airman gets detention, job at risk over porn by Court reporter | 2nd December 2010
Ohakea airman David John Gilmour was told his behaviour was unacceptable when he was sentenced on pornography charges yesterday.
Gilmour, 41, also faces an uncertain future in the New Zealand Air Force. He was yesterday sentenced to six months' home detention on 12 charges of possessing pornographic images and two charges of making intimate visual recordings between July 1, 2007 and May 1, 2009.
In the Wanganui District Court yesterday, Judge John Clapham told Gilmour his behaviour as a serviceman had been unacceptable.
Details of the offending and the circumstances that prompted the charges were not made available in court yesterday.
The Chronicle was unable to get additional information about the charges from the court or police prosecutions.
Gilmour's former superior officer was in court and said that the airman's retention in the Air Force was now under review.
Lawyer Roger Crowley was to have acted for Gilmour but legal process hadn't been completed in time for yesterday's sentencing, so Mr Crowley withdrew as counsel.
Judge Clapham said a pre-sentence report showed Gilmour had pleaded guilty at the earliest opportunity and was seeking help to stop him from offending again.
The judge ordered Gilmour's access to the internet be monitored and that if he did want to go online he would need permission from probation.

If that is the Dave Gilmour I know he was an Avionics Sgt and a really nice guy. He was keeping the Macchis flying for the sale last time I saw him.

Pornography seemed to be compulsory in the RNZAF when I was in. Every smoko room had it plastered on the walls!

Pornography seemed to be compulsory in the RNZAF when I was in. Every smoko room had it plastered on the walls! "making intimate visual recordings" (non-consent of subject implied) is a step (or several!) beyond what I assume was plastered on the walls. BTW, Playboy is now selling a hard drive with every issue up to 2009. Only a couple of hundred US or so from memory (of the article on whatever tech site I saw it on).

If that is the Dave Gilmour I know he was an Avionics Sgt and a really nice guy. He was keeping the Macchis flying for the sale last time I saw him. Judging by name and age that would have to be him. As you say a real nice guy, I worked with him a few years back.

The "Making" of an image refers to making a copy of. So even looking at an image online is 'making' it because your computer is making a copy of it somewhere on the hard drive. For real. It's a stupid definition because you can't posess a digital image without 'making' it and it sounds to people as though you must have been videoing someone illegally. What I don't understand here is how the hell a person can get charged with having pornography in a civil court!?! Since when has that been illegal?

Probably under the making part, he might have had a camera in a bathroom or something. I recall at least one person I know got done for exactly that, hidden camera in the bathroom and turned on when his step daughter had visitors over etc.
